Welcome to RAToM Europe. These Terms of Service ("Terms") govern your access to and use of our website, online store, products, and related services.

By visiting our website or purchasing from us, you agree to these Terms.

2. Scope

These Terms apply to purchases made through our online store by consumers. We currently ship to customers in the European Union, the United Kingdom, Norway, and Switzerland.

3. Online Store and Product Information

We make every effort to ensure that product descriptions, images, and pricing are accurate. However, minor variations in appearance, color, texture, or packaging may occur and do not automatically constitute a defect.

Product availability is subject to stock. We reserve the right to limit quantities, discontinue products, or correct errors in descriptions, pricing, or availability.

4. Orders and Contract Formation

The presentation of products in our online store does not constitute a binding offer. By completing checkout and submitting your order, you make a binding offer to purchase the selected products.

A contract is formed only when we accept your order by sending an order confirmation or dispatch confirmation.

We reserve the right to refuse or cancel orders in justified cases, including where:
- a product is unavailable
- there is an obvious pricing or listing error
- fraud or misuse is suspected

5. Prices and Payment

All prices shown in the store are in Euros (EUR) and include applicable VAT where required.

For deliveries to the United Kingdom, Norway, and Switzerland, additional import duties, customs charges, local VAT, or similar fees may apply depending on the destination country and shipping setup. Unless expressly stated otherwise at checkout, such charges are the responsibility of the customer.

Payment is due at the time of order using the payment methods offered at checkout.

6. Shipping and Delivery

We ship to:

- United Kingdom
- Norway
- Switzerland

Shipping costs and estimated delivery times are displayed during checkout.

Delivery times are estimates only and are not guaranteed. Delays caused by carriers, customs, force majeure, or other circumstances outside our control may occur.

Risk of accidental loss passes to the consumer upon delivery of the goods to the consumer or to a person designated by the consumer.

7. Right of Withdrawal

If you are a consumer in the EU, UK, or Norway, you may have a statutory right to withdraw from your purchase within 14 days without giving any reason, subject to applicable law.

For customers in Switzerland, where no general statutory withdrawal right may apply in the same way, we may offer a voluntary return or withdrawal period as described in our Refund Policy.

8. Returns and Refunds

If you return goods after handling them beyond what is necessary to inspect their nature, characteristics, and function, we may reduce the refund to reflect any diminished value, where permitted by law.

9. Defects and Statutory Warranty Rights

Your statutory rights in the event of defective goods remain unaffected.

Consumers in Germany generally benefit from statutory warranty rights for defective goods under applicable law. Consumers in the UK, Switzerland, Norway, and other destination countries also retain any mandatory local consumer rights applicable to the purchase.

If you believe a product is defective, please contact us at info@ratom.eu with your order number, a description of the issue, and, where appropriate, photos.

10. Limitation of Liability

We are liable without limitation for intent, gross negligence, injury to life, body, or health, and to the extent liability cannot be excluded under applicable law.

In cases of slight negligence, we are liable only for breach of essential contractual obligations, and then only for the foreseeable damage typical for the contract.

Nothing in these Terms limits or excludes statutory consumer rights or mandatory liability under applicable product liability law.

11. Intellectual Property

All content on this website, including text, images, graphics, logos, and product presentation, is owned by or licensed to RAToM Europe and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or commercially exploit any content from this website without our prior written consent.

12. Third-Party Services and Links

Our website may contain links to third-party websites or may use third-party tools, including Shopify and related service providers. We are not responsible for third-party content, products, or services unless required by law.

13. Privacy

14. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer residing outside Germany, you also retain the benefit of any mandatory consumer protection provisions of the law of your country of residence.

15. Jurisdiction

For consumers, mandatory statutory rules on jurisdiction apply.

If you are a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction shall be Munich, Germany, to the extent permitted by law.

16. Consumer Dispute Resolution

We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

17. Changes to These Terms

We may update these Terms from time to time. The version valid at the time of your order will apply to that order.
